This Oodles Messaging Policy governs all SMS, MMS, chat, and WhatsApp messages sent through the Oodles platform on behalf of our merchant customers. The purpose of this policy is to ensure full compliance with applicable laws, mobile carrier regulations, and industry best practices—including the TCPA, CAN-SPAM, Florida Mini-TCPA, and SHAFT compliance guidelines.
By using Oodles’ messaging features, merchants agree to adhere to the following requirements:
1. Consent / Opt-In Requirements
- Clear Consent: Merchants must obtain documented, verifiable consent from recipients before sending any message. This includes timestamps or signed agreements indicating permission.
- Timely Messaging: If there is a delay between collecting opt-in and the first message, reconfirm consent in the first outbound message.
- Purpose-Limited: Consent is valid only for the specific use case or campaign for which it was collected. Blanket or assumed consent is not permitted.
2. Sender Identification
- All outbound messages must clearly identify the business name, brand, or organization that collected the consent.
- Branding must be maintained in the initial and periodic follow-up communications for transparency.
3. Opt-Out Mechanism
- Every message must include a clear opt-out instruction, such as: “Reply STOP to unsubscribe.”
- Merchants must immediately and permanently cease messaging to recipients who opt out.
4. Quiet Hours and Message Frequency
- Quiet Hours: Messaging is restricted to 8:00 AM – 8:00 PM in the recipient’s local time zone to comply with Florida Mini-TCPA.
- Frequency Cap: No more than three message attempts per recipient in any 24-hour period across all messaging channels (SMS, MMS, chat).
5. Filtering Evasion
- Merchants must not attempt to bypass carrier filters or spam prevention systems by:
- Using rotating sender numbers
- Altering message content to evade filtering
- Re-sending rejected or blocked messages.
- Such behavior may result in immediate suspension.
6. SHAFT Policy Compliance
- Oodles strictly prohibits messaging related to Sex, Hate, Alcohol, Firearms, and Tobacco (SHAFT) in accordance with U.S. and Canadian mobile regulations.
- Alcohol & Age-Restricted Content: Age verification prompts must be included for alcohol-related content, such as: “Please confirm your birthdate: YYYY-MM-DD.”
7. AI-Generated Messaging and Disclosures
- Oodles enables merchants to use AI Agents to send automated replies, notifications, and campaign messages.
- Merchants are responsible for:
- Ensuring that AI-generated communications comply with all applicable consent and content rules
- Reviewing message content for accuracy and legal compliance.
- Ensuring that AI-generated communications comply with all applicable consent and content rules
- By using automated features, merchants consent to sending AI-driven communications under their brand identity.
8. Enforcement and Penalties
- Oodles reserves the right to suspend or terminate messaging privileges or accounts that violate this policy.
- Serious infractions may be reported to authorities and mobile carriers.
- Oodles may audit messaging history and metadata to enforce this policy.
9. Policy Updates
Oodles may update this Messaging Policy at any time. Updates will be communicated via email, the Oodles website, or in-app notifications.
